Terms of Service

These terms ("Terms") govern access to and use of the HomeYard website and software platform operated by HomeYard Ltd ("we", "us", "our"). By creating an account, starting a trial, or using the platform, you agree to these Terms.

1. The Service

HomeYard is a multi-tenant software-as-a-service platform for UK trade and appointment businesses. Features available to you depend on your plan (for example Free, Start, Run, Grow, or Scale) and any applicable entitlements. We may improve or adjust the product; material changes to paid plans will be communicated reasonably in advance where practical.

2. Accounts and Organisations

• You must provide accurate registration information and keep credentials secure
• Each organisation workspace is isolated; you may only access data you are authorised to see
• Organisation owners and admins are responsible for users they invite and for content stored in their workspace
• We may suspend accounts that abuse the service, violate these Terms, or create security risk

3. Trials, Subscriptions, and Payment

• Free needs no card. Start and Run require a card at the end of onboarding and charge immediately
• Fees are charged according to the plan and billing cadence you select
• Unless required by law, fees are non-refundable once a billing period has started
• You can cancel or change plans from Settings subject to the product's billing rules

4. Customer Data and Acceptable Use

You retain ownership of content and customer data you submit to your organisation workspace. You grant us a limited licence to host and process that data solely to provide the service.

You agree not to:

• Use the platform for unlawful purposes or to store unlawful content
• Attempt to access other organisations' data or circumvent security controls
• Abuse messaging, automation, or AI features in ways that harm recipients or violate anti-spam law
• Reverse engineer or resell the platform except under a separate Partners agreement

5. Your Customers

When you use HomeYard to interact with your own customers (enquiries, quotes, jobs, invoices, portals), you are responsible for your relationship with those customers, including privacy notices and marketing consent. We process that data as your processor as described in our Privacy Policy and any data processing terms we publish.

6. Intellectual Property

The HomeYard product, branding, and documentation are owned by HomeYard Ltd or our licensors. You may not copy or redistribute our software or marketing materials except as expressly allowed.

7. Availability and Liability

We aim for reliable service but do not guarantee uninterrupted availability. To the fullest extent permitted by law, our aggregate liability arising from the service is limited to the fees you paid us for the service in the 12 months before the claim. We are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded by law.

8. Termination

You may stop using HomeYard and cancel your subscription at any time. We may terminate or suspend access for material breach, non-payment, or misuse. After termination, we may delete organisation data after a reasonable retention window, subject to legal obligations.

9. Governing Law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes means you accept the updated Terms.
